We collect and process your personal data in the following cases when you use the services offered on our website: Online applications.
A. ONLINE APPLICATIONS
You can use the online link provided in the Careers section to complete the application form online.
If you use this function, your personal data will be processed exclusively for the purpose of carrying out the application process. We process the information that we receive from you as part of the application process, e.g. your letter of application, CV, certificates, details of your education and work experience, as well as correspondence and other correspondence with you as part of the application process. Your data will be treated in strict confidence and encrypted during electronic transmission. The legal basis for the processing described above as part of the application process is Section 26 of the Federal Data Protection Act (processing as part of the decision to establish an employment relationship).
As a rule, we do not require any special categories of personal data within the meaning of Art. 9 GDPR, such as health data, for the application process. If such information is exceptionally relevant for the application process (e.g. in the case of a severe disability, so that we can fulfill our legal obligations under labor and social law), we process it together with the other data provided by you. In this case, the legal basis for data processing is Art. 9 para. 2 lit. b GDPR in conjunction with § Section 26 para. 3 BDSG.
If you are not considered as part of the application process, your data and application documents will be deleted within 90 days of completion of the application process, unless you have given us your express consent during the application process to continue to store your data and application documents, e.g. for consideration of your person for a future position. If your application is successful, the documents and information provided will become part of your personnel file and will be stored and processed for the purpose of implementing and terminating the employment relationship.

If you wish to make use of the services offered, you must provide the personal data required for the respective service. If you do not provide us with this data, we will not be able to provide you with the requested service.
C. NON-EXISTENCE OF AUTOMATED DECISION-MAKING
We would like to point out that in the context of the use of our website and the use of our services offered on it, you will not be subject to a decision based solely on automated processing - including profiling - which produces legal effects concerning you or similarly significantly affects you.
We will only pass on or transfer your personal data to third parties if this is necessary to fulfill the contract with you, if there is a legitimate interest on our part, if you have given your consent and/or if we are obliged to do so by law or by official or court orders. Your personal data will be transmitted by us to third parties in the cases and for the purposes described below.
The newsletter is sent using “MailChimp”, a newsletter distribution platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.
The email addresses of our newsletter recipients, as well as their other data described in this notice, are stored on MailChimp's servers in the USA. MailChimp uses this information to send and analyze the newsletter on our behalf. Furthermore, MailChimp may, according to its own information, use this data to optimize or improve its own services, e.g. for the technical optimization of the dispatch and presentation of the newsletter or for economic purposes in order to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them itself or to pass it on to third parties.

The newsletters contain a so-called “web-beacon”, i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. As part of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval, is initially collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or the access times.
The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our intention nor that of MailChimp to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.
We work together with the IMZ International Music+Media Center (Stiftgasse 29, A-1070 Vienna) for the purpose of disseminating music and dance in audiovisual media. In this context, we also use the social media channels Facebook, Twitter, Google/Youtube, Instagram, Pinterest and LinkedIn. In addition, we use service providers who provide web hosting services for us and also use third-party cloud or web-based software solutions that enable us to manage and host personal data in the cloud with external service providers in order to relieve our own servers and work effectively with new software solutions. We have concluded order processing agreements with the respective service providers, which ensure that the respective service providers do not process the data for their own purposes, but only within the scope of our instructions and on our behalf. The legal basis for the use of service providers is Art. 6 para. 1 sentence 1 lit. f) GDPR (processing is necessary for the purposes of the legitimate interests pursued by the controller) in conjunction with Art. 28 GDPR (order processing).
Some of the service providers we use, who process personal data for us on our behalf and in accordance with our instructions as so-called processors pursuant to Art. 28 GDPR, are based outside the EU/EEA. Before transferring data to processors outside the EU/EEA, we ensure that the processor has an adequate level of data protection. For processors in countries such as Canada and Israel, this results, for example, from an adequacy decision by the EU Commission (so-called safe third countries), for processors in the USA from self-certification in accordance with the EU-US Privacy Shield and for other processors by concluding the EU standard contractual clauses before the start of processing by the respective processor.
Even without a special request, we naturally comply with our obligations to delete personal data (e.g. in accordance with Art. 17 GDPR) and therefore only store data for as long as is necessary for the provision of the desired service or the respective purpose.
For example, we only store the data in connection with the sending of our newsletter for as long as you are registered for the newsletter and we delete the data as soon as storage is no longer necessary, e.g. after you have unsubscribed from the newsletter or revoked your consent.
We store your personal data in connection with the registration and use of the non-public area for as long as you remain registered for the non-public area and your personal data will be deleted again if you delete your account and/or the user contract with you ends or is terminated.
Please note, however, that deletion will be replaced by blocking or restriction of processing if deletion conflicts with statutory retention obligations that we must fulfill. For example, we are required by law to retain contract-related communications with you for a period of up to ten years.
If you only use our website for information purposes, i.e. if you do not use one of the services offered on our website (see section 4 above), we only collect the data that your browser transmits to our server. For the use of cookies on our website, please see the separate information below in section 8.
Each time you use the Internet, your Internet browser automatically transmits certain information that we store in so-called log files. This involves the following data, which is required to display our website to you and to ensure stability and security: IP address (Internet Protocol address), date and time of the request, content of the request (specific page), access status/HTTP status code, amount of data transferred in each case, website from which the request comes, browser, operating system and its interface, language and version of the browser software. Cookies are set on your end device for this purpose. Your IP address is truncated before processing.

Amazon, iTunes and Google use cookies in order to be able to assign the exact page from which you clicked on the relevant affiliate link (to trace the origin of the order) and for the proper settlement of the affiliate remuneration. We do not receive any personal data from you from Amazon, iTunes or Google, but only information on the orders placed/amount of commission, without the names/addresses etc. of the customers.
FACEBOOK WEBSITE CUSTOM AUDIENCE:
Our website uses the “Website Custom Audience” retargeting technology of the social network Facebook, which enables us to show our website visitors who have already shown an interest in our website and content and are Facebook members relevant advertising/content on Facebook via the Facebook ad network. For this purpose, so-called Facebook retargeting pixels are integrated on our websites. We do not receive any personal data from Facebook, only statistical evaluations of the advertisements/content displayed on Facebook.

A) DATA WE PROCESS FROM YOU
AA) PARTICIPATION IN COMPETITIONS/PROMOTIONS
If you have a user account with the respective social network and, for example, take part in a competition or a similar campaign organized by us on Facebook or Instagram and/or would like to contact us via the messenger functions offered, we will collect the data from you that is required for participation in and implementation of the competition, including notification of the prize and its dispatch. This is usually the user name of the participant, and from the winners, after the prize notification has been sent, we will also ask for their real name and address and, if applicable, their email address. The legal basis is Art. 6 Para. 1 Sentence 1 b) GDPR (processing is necessary for the fulfillment of a contractual relationship with the data subject).
In order to take part in a competition, you must provide the above data. If you do not provide us with this data, you will not be able to take part in the competition and, if you win, we will not be able to send you the prize.
Your data will be stored and processed exclusively in connection with the implementation of the competition and the determination of the winner. All participant data - with the exception of the winner's data - will be stored for a period of three months after the end of the competition in order to be able to clarify any queries from participants) and then deleted. The winner's data (first and last name, address, etc.) will be stored for a period of two years to clarify any questions about the prize or the processing of the prize and will then be deleted. The participants' address data will only be used to send the prize and will be deleted after the prizes have been sent. If you take part in a competition held on one of our social media presences that we organize in cooperation with a competition partner who, for example, provides the prizes for the competition in question and you have been drawn as a winner, the respective competition partner will receive your first and last name and address for the purpose of sending the prize in question by the competition partner to the respective winner. The legal basis for the transmission is Art. 6 Paragraph 1 Clause 1 Letter b) of GDPR (processing is necessary to fulfill a contractual relationship). When participating in our competitions, you are not subject to any automated decision-making, including profiling.
BB) CONTACT VIA MESSENGER/ DIRECT MESSAGE
If you would like to contact us via messenger or direct message via the respective social network, we generally process your user name, which you use to contact us, and store any other data you provide to the extent that this is necessary to process/answer your request. The legal basis is Art. 6 Para. 1 Sentence 1 f) GDPR (processing is necessary to protect the legitimate interests of the controller).
B) (STATISTICAL) USAGE DATA WE RECEIVE FROM SOCIAL NETWORKS
In the case of Facebook and Instagram, we receive automated statistics about our fan pages/accounts from Facebook and Instagram via the Facebook Insights and Instagram Insights functions. The statistics include, among other things, the total number of page views, likes, information on page activities and post interactions, reach, video views/views and information on the proportion of men/women among our fans/followers.
The statistics only contain aggregated data that cannot be linked to individual people. We cannot identify you through this.
C) WHICH DATA THE SOCIAL NETWORKS PROCESS FROM YOU
In order to view the contents of our fan pages or accounts, you do not have to be a member of the respective social network and a user account for the respective social network is not required.
Please note, however, that when you access the respective social network, the social networks collect and store data from website visitors without a user account (e.g. technical data to be able to display the website to you) and use cookies and similar technologies over which we have no influence. You can find details about this in the data protection provisions of the respective social network (see the relevant links below at the end of this section).
If you want to interact with the content on our fan pages/accounts, e.g. comment on, share or like our postings/contributions and/or take part in competitions or similar campaigns organized by us on the fan pages/accounts and/or contact us via messenger functions, you must first register with the respective social network and provide personal data. We have no influence on the data processing by the social networks in the context of your use. To the best of our knowledge, your data is stored and processed in particular in connection with the provision of the services of the respective social network, and also to analyze usage behavior (using cookies, pixels/web beacons and similar technologies) on the basis of which advertising based on your interests is displayed both within and outside the respective social network. It cannot be ruled out that your data will also be stored by the social networks outside the EU/EEA and passed on to third parties.
